Terms of Service
These Terms of Service (the “Terms”) govern access to and use of the Seocreo service. By creating an account or using the service, the user accepts these Terms without reservation.
1. Purpose
These Terms define the rules for accessing and using the Seocreo service (the “Service”), available at seocreo.com and app.seocreo.com, operated personally by the person identified in the Legal Notice (the “Operator”).
2. Acceptance
Creating an account and using the Service imply unconditional acceptance of these Terms. A user who does not accept the Terms must not use the Service.
3. Description of the Service
Seocreo is a data-guided SEO writing tool. It notably allows users to:
- analyze a keyword or theme to identify SEO opportunities;
- generate an editorial outline, a structured article, its metadata, and a content cluster;
- create and manage multiple projects (target markets), multiple writing personas, and an article history.
The Service relies on third-party artificial intelligence models to produce text.
4. Access to the Service and user account
4.1 Eligibility
Use of the Service is reserved for persons who have reached the minimum age of digital consent in their country of residence — 15 in France, 13 in the United States (COPPA), up to 16 in certain EU countries. In all cases, the minimum age is 13. Minors must ensure they have the consent of their legal representative if the law of their country of residence requires it.
4.2 Account creation
An account is created via an email address and a password. Phone verification may be required to prevent fraud and secure the account.
4.3 Credentials
The user is responsible for keeping their password confidential. Any activity carried out from their account is presumed to be theirs.
4.4 One account per person
The user may not create multiple accounts to bypass credit or plan limits.
4.5 Accuracy of information
The user undertakes to provide accurate information (email, billing address) and to keep it up to date.
4.6 Support access to the account
The Operator's team may need to access a user's account for customer support, Service maintenance, resolution of a security incident, or compliance with a legal obligation. Such access is limited to strictly necessary information, logged in internal systems, and carried out in accordance with the Privacy Policy.
5. Plans, credits and features
5.1 Plans
The Service is offered as plans (Free, Starter, Pro, Agency). Each plan grants access to a number of credits per month, a number of projects, a maximum article length, and a set of features described on the pricing page.
5.2 Credits
- Subscription credits are renewed at each billing cycle. Unused credits are not carried over to the next cycle.
- Gift credits: 10 credits are granted to every new account (paid or free) upon sign-up, valid for 30 days and usable within the limits of the active plan.
- Credits purchased outside a subscription, reserved for paid plans, can be combined with subscription credits and do not expire as long as the account remains active.
- Consumption order: credits that expire the soonest (subscription or gift credits, based on their expiration date) are consumed first. Extra purchased credits are used last.
- Credits, in any form, are neither convertible into money nor transferable to another account. Cases of credit refund are detailed in the Terms of Sale article 11.
5.3 Consumption
Each generator step consumes one credit, displayed before confirmation. The credit is definitively consumed upon step launch, including when the input provided is invalid (keyword with no search volume, outside the target market, in another language, or of an unreadable nature) or when the result obtained does not meet the user's qualitative expectations. Cases of credit refund are detailed in the Terms of Sale article 11.
5.4 Commercial aspect
Acquisition of a paid plan or additional credits is governed by the Terms of Sale. Payment and tax collection are handled by Whop, Inc. as Merchant of Record for payment and tax purposes only. Seocreo remains the provider of the service.
6. AI-generated content
6.1 Ownership
The user owns the articles, outlines and metadata generated from their instructions, subject to payment of amounts due under the applicable plan. They may freely dispose of them (publication, resale, modification).
6.2 Nature of generated content
Content is produced by artificial intelligence models. It may contain inaccuracies, unverified claims, incorrect sources, or passages that do not correspond to reality. The user remains solely responsible for reviewing, verifying and publishing the content.
6.3 No SEO result guarantee
Search engine optimization depends on multiple factors outside the Operator's control (search engine algorithms, competition, quality of the host site, backlinks). The Operator guarantees no ranking, no traffic, and no conversion. The Service is a writing assistance tool, not a performance-based service.
6.4 User responsibility
The user is solely responsible for:
- the compliance of published content with applicable laws (intellectual property, image rights, personal data, sector-specific regulations);
- compliance with the terms of use of the platforms where they publish (search engines, social networks, marketplaces);
- any consequences (SEO penalties, third-party claims) arising from their publication.
7. User content and data
7.1 Ownership of inputs
The user retains all rights over the data they provide (ideas, keywords, persona content, pillar pages, notes).
7.2 Limited license to the Operator
The user grants the Operator a non-exclusive, worldwide, royalty-free license to use their inputs solely for the purpose of providing the Service (processing, storage, transmission to AI sub-processors, display within the Service).
7.3 No use for training
The Operator does not reuse the user's inputs or generated content to train its own models, and requires its AI providers not to use these data for training purposes. Anonymous and aggregated statistics may be used to improve the Service.
8. Prohibited uses
The user undertakes not to use the Service to:
- generate, store or distribute unlawful, hateful, defamatory, discriminatory, violence-inciting, pornographic content, content harming minors, or content that infringes third-party rights (intellectual property, privacy, image rights);
- impersonate a natural or legal person, or usurp an identity;
- send spam, phishing, or any form of misleading content;
- attempt to access accounts that are not their own, or bypass security measures;
- perform reverse-engineering, scraping, or any mass or automated extraction from the Service;
- create multiple accounts to multiply free credits;
- resell account access or share credentials with third parties;
- use the Service to build a competing service, in particular to train an AI model from Seocreo outputs.
9. Suspension and termination by the Operator
9.1 Suspension
The Operator may suspend access to an account, without notice, in the event of a serious breach of these Terms (fraudulent use, unlawful content, breach of security). Notification is sent by email within a reasonable time.
9.2 Termination
In the event of persistent breach or use that is manifestly incompatible with the Service, the Operator may terminate the account. No refund of amounts already paid or of unused credits is due in cases of serious breach.
9.3 Discontinuation of the Service
The Operator reserves the right to discontinue the Service with thirty (30) days' notice by email, with pro-rata refund of amounts already paid for the unused period (processed via Whop).
10. Termination by the user
The user may at any time:
- cancel their paid plan from the billing area. Access is retained until the end of the paid period in progress;
- delete their account from the settings area. Deletion is irreversible and results in the loss of projects, articles and unused credits.
Financial arrangements (withdrawal, refund) are detailed in the Terms of Sale and in Whop's Terms of Service.
11. Availability and evolution of the Service
11.1 Availability
The Operator uses reasonable means to keep the Service accessible. No guarantee of continuous availability is given. Interruptions related to maintenance, updates, or force majeure may occur.
11.2 Feature changes
The Operator may modify, add or remove features of the Service at any time. Substantial changes are announced within a reasonable time.
11.3 Plan changes
Prices, composition or credits associated with a plan may evolve. Any change unfavorable to a current subscriber is notified by email at least thirty (30) days before it takes effect. The user may then cancel their plan at no cost.
12. Operator's intellectual property
The “Seocreo” trade name, the domain name, the design, the interface, the source code, the documentation and all the components of the Service are the exclusive property of the Operator. The user is granted, for the duration of the contract, a personal, non-exclusive and non-transferable license limited to use of the Service in accordance with its purpose. Any other exploitation is prohibited.
13. Limitation of liability
13.1 Nature of the Service
The Service is provided “as is”, as a writing and SEO analysis assistance tool. The Operator guarantees neither the truthfulness of generated content, nor SEO performance, nor any specific commercial outcome.
13.2 Liability cap
To the extent permitted by applicable law, the Operator's liability towards the user in respect of the Service is limited to the amount actually paid by that user during the twelve (12) months preceding the event giving rise to the liability.
13.3 Mandatory provisions
The above limitations do not apply in case of willful misconduct, gross negligence, or to the extent that mandatory consumer law prohibits them. Consumer users in the European Union retain the benefit of the mandatory provisions of their country of residence.
14. Personal data
The processing of the user's personal data (email, password, phone, usage history, billing data) is described in the Privacy Policy. By using the Service, the user acknowledges having taken cognizance of it.
15. Changes to the Terms
The Operator may modify the Terms at any time. Substantial changes will be notified by email at least thirty (30) days before their entry into force. Continued use of the Service after that date constitutes acceptance. In case of refusal, the user may cancel their account before the effective date.
16. Miscellaneous
16.1 Assignment
The user may not assign their account or the rights arising from these Terms without the Operator's written consent.
16.2 Severability
If any clause is found to be invalid, the remaining clauses remain in force.
16.3 No waiver
The Operator's failure to invoke a breach does not constitute a waiver of the right to invoke it later.
17. Governing law and disputes
These Terms are governed by Tunisian law. Consumer users residing in the European Union retain the benefit of the mandatory provisions of their country of residence.
Any dispute will first be brought to the Operator's attention at support@seocreo.com for an attempt at amicable resolution. Failing agreement within thirty (30) days, the dispute will be brought before the competent courts of Tunis, subject to mandatory jurisdiction rules protecting consumers.
